Asbestos Identification and Survey Requirements

The new Asbestos Regulations [Health and Safety at Work (Asbestos) Regulations 2015] will require that all asbestos or asbestos containing materials in the workplace are identified by a competent person [Reg. 7]. If an assessment is not undertaken then asbestos must be assumed to be present.   If you have very good reason to believe the building and plant do not contain asbestos (for example all are new since the year 2000) then you may keep a document to that effect on record in lieu of a survey. There is expected to be a phase in period between when the new Regulations are enacted and when surveys are required. This transition period in the draft is 2 years following enactment [Schedule 2].

Where asbestos has been presumed to be present or has been identified there will be a requirement for an asbestos register to be prepared, and for an asbestos management plan to be in place.
