In June 2018 Worksafe released a policy clarification for residential landlords and their responsibilities regarding their duties with asbestos in their properties under the Health and Safety at Work (Asbestos) Regulations 2016.
The clarification outlines the landlords, as PCBU’s, need to identify asbestos or assume its presence on all their properties constructed prior to the 1st January 2000. If asbestos is identified or assumed to be present the tenants must be given advice on how to stay safe in regard to the asbestos risk. The clarification also outlines what to do if refurbishing or demolishing your property (taking down a garden shed, or replacing some kitchen floor vinyl). You must get the areas undergoing refurbishment or demolition tested for asbestos. Any asbestos identified will be required to be removed if it is going to be disturbed. To do this you may need to engage a licensed asbestos removalist prior to the refurbishment or demolition.
